1. Agreement to Terms

By accessing or using Motion Klicks' services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services. These terms apply to all visitors, users, and others who access or use our video production and editing services.

2. Services Description

Motion Klicks provides professional video production, editing, and social media management services including but not limited to:

• Video production and filming
• Video editing and post-production
• Social media content creation
• Brand video development
• YouTube content optimization
• Instagram Reels and TikTok video creation

3. Service Terms and Project Scope

All projects are subject to the following terms:

• Project scope, deliverables, and timelines will be defined in a separate project agreement or proposal
• Changes to project scope may result in additional fees and timeline adjustments
• Client must provide all necessary materials, information, and approvals in a timely manner
• Delays caused by client may result in project timeline extensions
• We reserve the right to refuse service to anyone for any reason at any time

4. Payment Terms

Payment terms are as follows:

• A deposit of 50% is required before project commencement unless otherwise agreed
• Final payment is due upon project completion and before final delivery
• Payments can be made via bank transfer, UPI, or other agreed methods
• Late payments may incur additional charges and delay project delivery
• All prices are in Indian Rupees (INR) unless otherwise stated
• Refunds are subject to our refund policy and project stage

5. Intellectual Property Rights

Intellectual property ownership is governed by the following:

• Upon full payment, client receives full rights to the final delivered video content
• Motion Klicks retains the right to use completed projects in our portfolio and marketing materials unless otherwise agreed in writing
• Client must have proper rights and licenses for any materials provided to us (music, images, footage, etc.)
• Motion Klicks is not responsible for copyright infringement of client-provided materials
• Stock footage, music, and assets used are licensed appropriately for commercial use

6. Revisions and Modifications

Revision policy includes:

• Each project includes a specified number of revision rounds as outlined in the project agreement
• Additional revisions beyond the agreed number may incur extra charges
• Major changes to project scope will be treated as new projects and billed accordingly
• Revision requests must be consolidated and submitted in writing
• Revisions must be requested within 14 days of initial delivery

7. Client Responsibilities

Clients are responsible for:

• Providing clear project briefs and requirements
• Timely provision of all necessary materials and feedback
• Ensuring all provided content is legally owned or licensed
• Making timely payments as per agreed schedule
• Providing constructive and specific feedback during revision stages

8. Cancellation and Refund Policy

Cancellation terms:

• Projects can be cancelled with written notice
• Deposits are non-refundable once work has commenced
• Partial refunds may be considered based on work completed at time of cancellation
• Client will receive all work completed up to the point of cancellation
• Motion Klicks reserves the right to cancel projects with full refund if unable to meet client requirements

9. Confidentiality

We respect the confidentiality of our clients' information. Any confidential information shared during the course of our business relationship will be kept confidential and not disclosed to third parties without prior written consent, except as required by law. Both parties agree to maintain confidentiality of proprietary information, trade secrets, and sensitive business information.

10. Limitation of Liability

Motion Klicks shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use our services. Our total liability shall not exceed the amount paid by the client for the specific project in question.

11. Warranties and Disclaimers

We warrant that our services will be performed in a professional and workmanlike manner. However, we make no warranties regarding the results that may be achieved through our services. All services are provided "as is" without warranty of any kind, either express or implied.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in Ludhiana, Punjab, India.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after revisions become effective, you agree to be bound by the revised terms.
